Terms and Conditions
Introduction
These Terms and Conditions (“Terms”) govern your use of the NannyLane platform (the “Platform”), owned and operated by NannyLane Pty Ltd (ABN 51 689 844 719) (“NannyLane”, “we”, “our”, “us”). By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy.
Nature of the Platform
NannyLane is a digital marketplace that connects families seeking childcare services (“Parents”) with independent caregivers (“Nannies”). NannyLane does not employ, manage, or control any Nanny or Parent. All services are provided directly between users, and NannyLane acts solely as a technology intermediary.
User Eligibility
By registering, you confirm that you are at least 18 years of age and legally capable of entering into binding contracts in Australia.
Verification
All Nannies are required to provide:
- Valid Government ID
- Current Working With Children Check (WWCC)
Optional documents may include:
- Police Checks
- First Aid Certificates
Important: NannyLane does not independently verify the authenticity of documents and disclaims all liability for misrepresentation. Parents must conduct their own due diligence.
Payments and Fees
- Payments are facilitated via Stripe.
- Standard users may incur a $5 match fee per instant booking.
- Premium “Founding Family” subscribers pay $199 per year.
- Regular subscribers pay $365 per year.
Funds for completed jobs are held securely and released once the Parent confirms completion via verification code. NannyLane does not hold funds on trust and assumes no fiduciary duty.
Cancellations and Refunds
- Parents and Nannies may cancel bookings according to NannyLane’s Cancellation Policy.
- Refunds, if applicable, are processed per Stripe’s standard timelines.
- Fees are otherwise non-refundable, unless required by Australian Consumer Law.
User Conduct
Users agree not to:
- Provide false or misleading information
- Use the Platform for unlawful purposes
- Harass, threaten, or harm other users
- Circumvent payment mechanisms or platform policies
Liability and Disclaimers
To the maximum extent permitted by law, NannyLane:
- Disclaims all warranties regarding the services or interactions between users
- Is not responsible for injury, loss, or damages arising out of engagements between Parents and Nannies
- Users agree to hold NannyLane harmless from all claims arising from use of the Platform
Dispute Resolution
- Users are encouraged to resolve disputes directly.
- If unresolved, NannyLane may offer optional mediation.
- Nothing limits your rights under the Australian Consumer Law.
Termination
NannyLane may, at its sole discretion:
- Suspend or terminate accounts that breach these Terms or pose a risk to others
- Modify, suspend, or discontinue any aspect of the Platform at any time without liability
Governing Law
These Terms are governed by the laws of Australia. All disputes are subject to the exclusive jurisdiction of Australian courts.
